UK Cryptoasset Authorisation: Are You Ready?

The UK Crypto Regime is Changing

The UK’s new cryptoasset regulatory regime is coming into force on 25 October 2027, bringing a wide range of digital asset activities within regulatory scope for the first time. The UK is moving beyond its current patchwork approach and introducing a framework that will require many cryptoasset businesses to obtain authorisation before operating in, or serving customers in, the UK.

If your business deals with digital assets, the formal gateway for applications for authorisation is opening on 30 September 2026, and now is the best time to assess whether the new regime will apply to you.

In the future, if a UK-issued stablecoin gains wider adoption and becomes integral to day-to-day life in the UK for payments, transfers and other daily transactions, then the stablecoin could be recognised as systemic by HM Treasury. This may lead to additional Bank of England supervision, as a mishap with the issuer could lead to disastrous consequences for users or the economy.

Who Will Be Affected?

The regime will cover businesses involved in stablecoin issuance, cryptoasset custody and safeguarding services, staking services, cryptoasset trading platforms and exchanges, and any business dealing in or arranging cryptoasset transactions.

Importantly, the rules are not limited to UK-based firms. Overseas businesses serving UK customers may also fall within scope and require UK authorisation.

Why Act Now?

Many firms underestimate the amount of preparation required to obtain authorisation. The application process typically requires businesses to demonstrate appropriate governance arrangements, effective risk management and compliance frameworks, robust custody and safeguarding controls, operational resilience and cybersecurity measures, and financial resources sufficient to support the business.

For firms that have grown in a relatively unregulated environment, meeting these expectations can require significant planning and operational changes.

The Authorisation Window is Fast Approaching

As mentioned above, the FCA’s formal application gateway opens on 30 September 2026 and closes on 28 February 2027. Firms wishing to continue providing regulated cryptoasset services in the UK when the new regime takes effect should already be assessing their readiness and preparing their applications.

With the gateway opening in a matter of weeks, businesses that delay may find themselves facing compressed timelines, increased implementation costs and regulatory uncertainty.

Early preparation provides valuable time to identify gaps, strengthen governance arrangements and ensure the application process progresses as smoothly as possible.
