A Transfer of Equity is the legal process of changing the ownership of a property by adding or removing someone from the title deeds. Unlike a sale, at least one of the existing owners remains involved in the property.

Transfers of equity commonly arise following a divorce or separation, after marriage or cohabitation, on the death of a joint owner, or when parents wish to gift part or all of a property to a child. While the process may appear straightforward, every situation is different and requires careful legal consideration to ensure all parties’ interests are protected.

There can be important financial implications, including Stamp Duty Land Tax (SDLT), Capital Gains Tax and Inheritance Tax considerations. Where a mortgage is involved, lender consent may also be required before any transfer can proceed.
